Abstract

This article provided an explication of the axiological foundations of liberalism and constitutionalism using the dialectical method of the unity of the historical and logical investigation. As a result, the author concludes that these phenomena have different intentions in state construction. Thus, in the era of modernity, when constitutionalism and liberalism appeared, the main objective was to limit state power in the name of development of individual freedom. The author shows that freedom as it is can be conceptualized as an indissoluble axiological unity of private and public autonomy. Constitutionalism initially had such understading, but liberalism gave priority to private autonomy whereas the public sphere was sought to eliminate. Failure in understanding this issue has led to the fact that so far in Russian social sciences and law dominates the identification of these different phenomena. That`s why we have a corrupt government and oligarchic economy instead of constitutionalization of state power and economy. As a result, the democratic potential of the Russian Constitution of 1993 still remained unrealized.
